The average sold price was $89 psf with a range of $81 to $99 psf. The average days on market were low at 25 days and a range of 6 to 44 days.

Tenant complains that when heaters are on in 2 rooms, the electrical circuit shuts

down. The electrical circuit needs repair.

3A: The living room does not have an electrical outlet for the AC. The electrical wire is hooked

to another room.



The back door of the unit leaves a 2 inch gap at the top. It is the only door that has such

a large gap. The door does not fit the back door frame. It needs to be replaced so that rain

does not come in at the back.



Window at the back is broken, one of the glass needs to be replaced.



3B: The tenant complains that the water floods into the living room at least once a year from heavy down pour. All the water

from the surrounding area gathers at the front of the unit, and goes into the living room. There needs to

2 drains installed at the front of this unit. Landlord maybe liable for any damage to the tenant due to the

flooding.

Looking in the following High school districts / area; COLUMBIA, HSV, GRISSOM, BOBJ, SPARKMAN, HAZG, BUCK and MADC. I did add the new James Clements school in Madiosn. This filters out most declining neighborhoods.



There are some workable points but in our current market the offer probably won't gain much traction with the prospective buyer. Two critical points I see is that there is not a sales price and you are not offering to pay any of the purchasers closing costs. In any contract we must have a set price. Asking the tenant to pay for an appraisal and then setting the sales price is inviting problems.















What if you were not happy with the price that the buyer's appraiser came up with? In our current market seller can expect to pay most if not all of purchaser's closing costs. Your proposal does not offer any assistance with closing costs. If we were in the real estate market of 2005 when there was a shortage of inventory your proposal might have more appeal to a buyer.



While our local market is slowly recovering there is still an oversupply of inventory. In the $140,000 to $145,000 range there are over 70 active, competing listings in the greater Huntsville area. When I filtered those listings for full brick homes that are similar in age and size there were 42 listings. Some of the competing homes are new construction and most were either in the city or much closer to town than your houses.

Homes of Huntsville; Alabama home sales during July 2012 up 3.6 percent from 2011. July new home sales in Alabama's five metro markets, representing approximately seventy percent of all statewide transactions, experienced a 17.5 percent decrease from the prior month. Sixty percent of metro areas have experienced YTD increase in new home sales compared to 2011 with Montgomery (up 24%) posting the best results followed by Tuscaloosa (18%) and Birmingham (15%). YTD new home sales have declined in Mobile (down 22%) and Huntsville (down 6%). Demand: In July, Alabama new home sales were outperformed by the US market which reflected an increase of 25.3 percent from July 2011 and up 3.6 percent from the prior month, according to the US Census Bureau & HUD. The release also reported that the results from the South region were up 9.7 percent from July 2011 but 1.6 percent down from last month. New Home Pipeline: July statewide housing starts decreased by 2.5 percent from the prior month and decreased 1.8 percent from July 2011. YTD housing starts are up 3.4%. July statewide building permits were down 3.4 percent from the prior month and 6.2 percent from July 2011. YTD building permits are up 4.1%. Residential Construction Employment: According to the Alabama Dept. of Industrial Relations, statewide residential construction employment was up 1.1 percent (700 jobs) to 61,400 from last month but remains down 6.9 percent or 4,600 workers from July 2011. Local Results: 9 out of the 27 home builder associations (33 - up from 30% in prior month) reported gains in building permits from the prior month (June 2012) while 9 associations (33% - down from 37%) reported gains in housing starts. As the market transitions into the third quarter of 2012, statistical volatility is anticipated. Real estate sales are seasonal and third quarter sales typically begin to gradually decline from the prior "sales peak" second quarter. Through July, seventy-two percent (18 of 25) of the local housing markets have experienced year-to-date (ytd) sales growth from 2011 and that is welcome news for Alabama consumers as well our state's real estate community. On the other hand, continued anemic US job creation/economic growth, strict underwriting standards, uncertainty of election (ie 2013 tax policy) and the global economic slowdown top the list of concerns that market watchers cite as elements that could possibly impact the fragile housing recovery. I'm surprised your closing attorney of agent didn't cover this but you can take your deed to the courthouse or an annex to file for homestead exemption. From your house the courthouse would be the closest. If there is not a parking spot on the square park in the lower level of the parking garage on the southwest corner of the square. The entrance is on Fountain Circle just under where the red car is parked at the link below. Park at a meter and enter the courthouse on the west side. The officer at the metal detector will direct you to the license department. If there is a line walk past it. (The link will be for car tag renewals.) Once in the department present you deed, sign a form and you are done. You may have heard rumblings in the news lately about something called Quantitative Easing, or QE3 for short. If you're in the market to buy or refinance a home, this is one story to follow. Read on to learn why.
What is Quantitative Easing?Quantitative Easing is the concept of the Fed becoming a buyer of Treasuries and Bonds to try and stimulate the economy. Oftentimes, the Fed does Quantitative Easing when they are hoping to achieve the following things:
To create inflation and avoid a deflationary economy
To lower the unemployment rate
To boost Stock prices
Keep in mind that one of the consequences of Quantitative Easing is that the US Dollar will weaken. This makes US exports more affordable abroad, as well as makes imports appear relatively more expensive. This will help large multi-national companies???which have a large influence on the economy and the major Stock market indices???thus stimulating our economy and hopefully our Labor Market, which continues to struggle.
What Happened During the Last Round of Quantitative Easing (QE2)?It's important to understand that home loan rates are tied to Mortgage Bonds, and when Bonds improve, home loan rates typically move lower. History has shown that Bonds and home loan rates typically improve in anticipation of Quantitative Easing, but then worsen once the official announcement is made. Think about the old investing adage: "Buy on the rumor, and sell on the news."
In a speech delivered on August 27, 2010 in Jackson Hole, Wyoming, Fed Chairmen Ben Bernanke mentioned that QE2 may be coming, saying, "I believe that additional purchases of longer-term securities, should the FOMC choose to undertake them, would be effective in further easing financial conditions." But the Fed didn't take action and begin QE2 until November of that year. Bonds and home loan rates enjoyed a nice rally until the actual official announcement was made.
However, once QE2 officially began in November 2010, we saw a big move higher in Stocks. By the time QE2 concluded in June 2011, the S&P 500 had risen 19%. And when investors moved their money into Stocks during this time, Bonds and home loan rates suffered as a result.
The Bottom LineOn August 31st of this year, Bernanke was back in Jackson Hole, Wyoming delivering another Economic Outlook and Monetary Policy. While he did not commit to another round of Quantitative Easing or QE3, he hinted that one was possible.
If rumors of QE3 continue to swirl, we should continue to see great home loan rates leading up to any actual announcement.
But if the Fed decides to move forward with QE3 and Stocks rally like they did during QE2, the Stock rally could come at the expense of the Bond markets???which would in turn push home loan rates higher.
The great news is that home loan rates remain near historic lows, making now a great time to purchase or refinance a home. Last week, I had the opportunity to attend the Republican National Convention along with 2012 NAR Treasurer Bill Armstrong and 2012 Vice President and Liaison to Government Affairs Scott Louser in Tampa, Florida. While everyone was nervous about Hurricane Isaac hitting during the convention, it didn???t dampen the enthusiasm for our message that Homeownership Matters to America!
The convention was an outstanding opportunity for REALTORS?? to meet and talk with GOP elected-officials and candidates about the important role that real estate plays in our economy.
We also saw how important it is for REALTORS?? to get involved in the political process. The week before the convention when the platform was being drafted, the committee overlooked including language about protecting the mortgage interest deduction (MID). Shirley Wiseman and April Newland, both REALTORS?? who were on the platform committee, for language that explicitly puts Republicans on record pledging protection of the MID, although it first gives a nod to the party???s priority to seek comprehensive tax reform. If that doesn???t pass, protecting the MID is paramount. It is an excellent example of REALTORS?? being at the right place at the right time.
The Real Estate Roundtable also hosted a panel discussion on the importance of a strong real estate market to creating a robust economic recovery. There were representatives from commercial, hospitality, multifamily, and architects to make the case. I had the opportunity to represent REALTORS??. Homes of Huntsville Our good friend and former REALTOR??, Senator Johnny Isakson was also a member of the panel. We talked about the importance of maintaining federal incentives for homeownership and ensuring that market-stifling high down payments are not the result of a narrow definition of provisions in the Dodd-Frank law. Huntsville AL MLS We all advocated for a broad definition of these provision, just as Congress intended. Senator Isakson was outstanding on the issue since he was involved in writing the language. The Real Estate Round Table will sponsor the same panel at the DNC convention, and 2012 NAR First Vice President Steve Brown will be representing REALTORS??. If you have a chance, Overall it was a remarkable experience, and I was proud to see our REALTOR?? involvement pay off at such a crucial moment.

The ???Grand-ol-Gop??? has a habit of feathering their own nest, ( and the ones who tag along with them ) without much regard for much of anything/anyone else.
Taxes are too complicated. It???s easy to get lost in the tax deduction trap. Let???s see???.You pay the govenment $1 in taxes and they give you 25 cents back as a deduction? Sounds like a good deal for the government. They gain 75 cents every time and you lose 75 cents every time.
Why would you need any deduction if there was NO tax in the first place? Now that???s TAX reform!
As I read this post, what jumped out to me was exactly the concern noted by Dick ??? Sep 5 ??? I really am starting to wonder what is the GOP ???vision??? for the future of this country. I beginning to suspect there is no ???vision??? ??? just mantra ??? (1) no tax and (2) no government ??? except to dictate to females.

I personally think the importance of MID is very much overblown. First, there are many home buyers who do not pay any income taxes; secondly the difference in what they would pay without the deduction is not that great except for the very high income individuals. Most decisipons to buy are NOT based on MID>

Market recovery driven by investors;Investors are buying homes at a more rapid pace than ever before, and this time their investments actually make sense. Most are buying homes below replacement cost, or at prices that allow for a reasonable rental return.
Across the 167 metro areas we analyzed, investor activity rose to 29.6% of all transactions in the first quarter of this year, up from the trough of 23.6% in Q4 2009. Our research leads us to believe Q2 activity exceeds Q1, and since last quarter, investor activity has already spiked 2%!
Investor activity has returned to the markets where investors got burned the most. These markets include Miami, Phoenix, Las Vegas, Sacramento, and Riverside (CA). Some markets are now completely dominated by investors, such as Las Vegas (50% of all activity) and Phoenix (46%).We've helped several clients purchase homes of Huntsville without having physically seen them first and can give you a lot of additional information on candidate homes, neighborhoods and areas. We can preview homes, provide our impressions and lots of additional photography. I am however always uneasy until clients are able to see the house and get settled in. If there is any possible way it's best to make at least a short house hunting trip or haveSmall markets are also attractive to investors, especially in inland California (Merced, Modesto, Bakersfield, Vallejo, etc.) and second home buyers are also sensing the bargains, causing huge increases in Naples, The Villages, Tucson and Panama City.
The naysayers will surely point to these facts as a false recovery. While they are technically correct, we are not concerned at all, and are embracing the return of private capital. Most of these investors are paying all cash and buying homes below replacement cost. They are helping the market recover by removing supply at the low end of the market and driving real buyers to higher price points, including new homes. We don’t see a scenario where they dump their homes en masse on the market unless it becomes crystal clear that home prices are headed down again.
Normal wear and tear in rental properties;Source; Sarah Taggart law firm;In the past several weeks our law firm has seen a dramatic increase in the number of small claims court disputes regarding security deposits. This month we are going to discuss the legal concept of "reasonable wear and tear" and the security deposit.

Classically, a security deposit is designed to ensure that the rental premises are returned to the landlord in roughly the same condition that they were leased out, minus "reasonable wear and tear". That phrase often confuses landlords - the tendency is to think that all tenant-caused "damage" (or dirt) is the proper province of a security deposit OR that the security deposit can be used to help defray the costs of "turning" a unit.

That is not the case. "Reasonable wear and tear" includes deterioration of the rental premises that occurs during normal conditions. For example, paint may fade, electrical switches may wear out and break, pull strings on blinds may fray or break, carpet and tile may wear down. These things happen even if the tenant cleans regularly and cares for the premises reasonably. "Damage", on the other hand, occurs from "unreasonable use" and can include extreme build up of dirt or grime, stains on the carpets, broken windows, scorch marks on granite. As a general rule, the longer the length of the tenancy, the more "wear and tear" is reasonable. I find that if landlords look at the security deposit as a damage deposit they are less inclined to make questionable deductions.

Making questionable deductions from a security deposit can be a costly mistake: as noted above, many tenants will sue in small claims to recoup their deposit. The burden of proof is on the landlord to establish that damages exceed "reasonable wear and tear". Proper documentation, including a move-in inspection and photographs, are essential. You must also send the tenant a letter within 35 days of the "end" of the tenancy itemizing any deductions.

Also: routine "cleaning fees" or "carpet cleaning fees" that are always assessed is not a good practice. Each rental premises should be evaluated individually before you begin deducting from the deposit

The U.S. Bureau of Labor Statistics (BLS) reported that the July, 2012 unemployment rate jumped to 8.3% That’s bad. It means 12.9 million people are without work. And since it is easy to read such statistics without much thought, let’s emphasize it a bit. In the United States alone, 12,922,618 people are “newly” unemployed. These are moms and dads who worry about feeding their children, keeping their homes, and clothing themselves. It’s the equivalent of the entire population of Switzerland and New Zealand – COMBINED. But it’s far worse than that, really. A more accurate unemployment figure for the United States is 15.1%. And we’re not pulling that data from some anti-government site either. No, it’s a figure that comes directly from the U.S. government itself. You see, most Americans don’t realize it, but the government actually tracks 6 different unemployment figures (labeled as U1 thru U6). Since incumbent administrations (of either party) don’t want bad unemployment numbers pinned to them, they only publish a lower figure as the “official” unemployment rate. Currently, the U3 is the published, “headline” rate. That’s what’s at 8.3%. The higher fifteen percent number we mentioned above is the U6 rate, which includes those who have given up looking for jobs in the “short-term.” That means there are far more jobless people in the United States than you might think. 23.5 million, to be precise. That’s more than the entire population of Australia! Up until 1994, the government also tracked another figure. It included long-term “discouraged workers” (as they are officially called). These were people who had given up looking for a job longer-term, or who were forced to work part-time in a low-paying job because they couldn’t find anything else. The government didn’t like these people mucking up its numbers. They didn’t paint a rosy picture. So these folks were conveniently dropped from any official statistic of the U.S. government. The U.S. Bureau of Labor Statistics doesn’t even track these people at all anymore. The government says they don’t count. But John Williams, an economist who runs ShadowStats.com, thinks they do count. So he continues to compile this information. He calls it the SGS Alternate. The latest chart with data since 1994 is to the right. Using the same analysis model the government used to use, he calculates the true number of people currently out of work at 23.6%. That’s a whopping 36.7 million Americans. That’s more than the entire population of Canada! Still not convinced? CNN wasn’t so sure either, so they did their own investigation earlier this year. Their report in May 2012 found that ShadowStats.com -- and the government -- may have it ALL wrong. A person is counted as part of the labor force if they have a job or have looked for one in the last four weeks. This year, only 63.6% of Americans over the age of 16 fell into that category, according to the Labor Department. That means the remainder are not working or not looking. That number now stands at 86 Million people. That includes people who are retired, in school or staying home to raise kids. These are people who truly aren’t looking for work. But when CNN filtered those people out, they still came up with between 36-58 million people in the U.S. who are involuntarily jobless ... or who are working part time because they can’t find anything better. This is a staggering number. It means these people are either draining their savings and retirement funds to survive, or relying on government assistance to get by.

Even if that is not an issue for you. It will make an eventual resale more difficult.
Tax records are notoriously inaccurate. It is possible to provide current information to the assessor. That the listing shows 3 acres and the tax records 2.9 acres is not surprising. The original listing agent got the data from seller. Sellers are prone to pad acreage and square feet. IN all cases, especially when a property is bank owned, it is best to confirm all the data that is critical to making a decision.

Alabama new home sales during the 2nd quarter of 2012 were 6.6 percent higher than the same period in 2011. Year-to-date (YTD) through June, sales are up 8.7 percent from 2011. June residential sales in Alabama experienced a growth rate of 6.0 percent when compared to June 2011. June new home sales in Alabama's five metro markets, representing approximately seventy percent of all statewide transactions, experienced a 16.6 percent increase from the prior month. Sixty percent of metro areas have experienced YTD increase in new home sales compared to 2011 with Montgomery (up 46%) posting the best results followed by Birmingham (25%) and Tuscaloosa (17%). YTD new home sales have declined in Mobile (down 23%) and for Huntsville AL real estate (down 5%). Demand: In June, Alabama new home sales outperformed the US market which reflected an increase of 15.1 percent from June 2011 but an 8.4 percent decline from the prior month, according to the US Census Bureau & HUD. The release also reported that the results from the South region were up 6.5 percent from June 2011 but 8.6 percent down last month. Supply: Statewide new construction inventory has declined by approximately 13 percent from last June which is consistent with US trend (down 24%). All metro markets have experienced reductions in inventory since June 2011. Birmingham (down 20%), Mobile (-10%) and Tuscaloosa (-9%) led the state in inventory reduction. Alabama's metro markets in June reflect 4.1 months of new home supply, a significant improvement from 4.9 months of supply in June 2011 and down from 4.9 months from May 2012. According to the US Census Bureau, the US inventory of new homes for sale decreased to 144,000 homes or 4.9 months' supply, also a big improvement from 6.6 months of supply in June 2011 (down 25%). Pricing: Alabama's metro market's median new home sales price in June was $226,766, an increase of 8.2 percent from last month and an increase of 13.9% when compared to June 2011. New Home Pipeline (see graph): June statewide housing starts increased by .6 percent from the prior month and increased 7.8 percent from June 2011. YTD housing starts are up 4.3%. June statewide building permits were down 6.2 percent from the prior month and 2.2 percent from May 2011. YTD building permits are up 6.2%. Residential Construction Employment: According to the Alabama Dept. of Industrial Relations, statewide residential construction employment was up .2 percent (100 jobs) to 60,800 from last month but remains down 8.9 percent or 6,000 workers from June. Local Results: 8 out of the 27 home builder associations (30% - down from 37% in prior month) reported gains in building permits from the prior month (May 2012) while 10 associations (37% - down from 70%) reported gains in housing starts. Favorable weather conditions have positively impacted new home construction in recent months. The new home industry is expected to gradually improve in 2012 and beyond as the general consensus is that the worst market conditions are in the rearview mirror. One caveat, weak overall US job creation and uncertainty resulting from Europe financial crisis and upcoming general election (future US fiscal path) continue to give industry watchers reason for significant concern. HUNTSVILLE, AL — (July 20, 2012) — Homes sales surged by 15.79 percent in the first half
of 2012 when compared to the same period in 2011 according to new data prepared by the
Huntsville Area Association of REALTORS® (HAAR). Home sales rose by 309 units in the six
month period ending June 2012 to 2,266 when compared to 2011’s 1,957 sold units.
At $164,360 the average single-family home median price – the figure at which half of the
homes sold for more and half sold for less – for the first half of the year fell by 4.13 percent
compared to 2011’s $171,440 due to the increase in home sales in the $200,000 and under price
range.
"The Huntsville/Madison County housing market continues to show steady and sound growth.
Our market has not experienced the extreme cycles that many areas of the country have
demonstrated. During the recession, at least for the housing market, steady growth was rare; we
exceeded that expectation," said Oscar Gonzales, HAAR CEO.
Available Properties
The average number of available properties (active listings) in the first half of 2012 fell by 7.76
percent to 2,871 compared to the same period in 2011 which posted inventory of 3,112.
The Huntsville Madison County area month’s inventory of single-family homes for June 2012
came in at 7.9 months compared to the national month’s inventory of single-family homes,
which was approximately 6.6 months for June 2012 according to the National Association of
REALTORS® (NAR).
Days on Market
The June 2012 Average Days on Market (DOM) fell by 1 day to 105 compared to May 2012’s
106 days and down by 1 day from June 2011.

Foreclosures might or might not be a good deal. There is a whole new set of potential problems when working with foreclosures. The most common is the condition of the property and getting funding. If the property is in poor condition lenders may not want to finance. There may also be a right of redemption that will prevent lenders from funding without a redemption bond (About $2,000). I wouldn't rule out foreclosures but one has to be careful. The link below is to some foreclosure and pre-foreclosure listings in the Huntsville AL MLS that might catch your eye.

While the market might bear a higher rent, the summary of comparable homes below along with the archive listing of your house point to something in the $995 - $1,100 range. We could market the house at the upper end of the range or slightly greater and gauge our pricing by showing activity. On rentals in this price range we should see 2 - 3 showings per week. If showings are consistently less we would know we are priced too high. On market value the best we can do to estimate market value is to see what comparable recent sales have been. The subject is listed at $100 per square foot. It does not have a view of nor does is border the golf course. The link below is to a summary of the four comparable homes that I could find in the MLS. The average sold price was $91 psf with a range of $84 psf (Short sale) and $95 psf. We will need to confirm this. I found several active Huntsville MLS listings in Piney Creek. None indicate a bank owned or pre-foreclosure. I tried looking back to 01/01/11 and the one sale in the addition was not a bank owned property. It is a short sale meaning the seller is asking the lender to be able to sell the house for less than is owed on the mortgage. Short sales are like a blind auction with no sent end date. We submit offers to the lender and may wait weeks or months before getting a response. In the meanwhile additional offers will be accepted. There is already at least one offer waiting lender review. I cant see any changes in the property from 2000 until now. Even at a very generous 3% annual increase in value the property would only be worth around $193,000. It will be nearly impossible to find similar sales in the area to estimate market value but it took 165 days for the house to sell in 2000 so we can assume $142,250 was a fair market value then The home is not near a flood zone. The link below is to the Google satellite image of the property. To the northeast there are some mobile homes and behind the two mobile homes it looks like a barn with junk cars around it.
