How does the scam work? The caller impersonates a microsoft representative and claims there is a serious virus or issue with the consumer’s computer. The caller may warn that if the problem is not solved, the computer will become unusable. In more recent calls, they have claimed that the individual receiving the call has had their account hacked into and bogus messages with viruses attached are being sent out to others in their name. To “fix” the problem, the consumer is directed to visit a website or download a program that gives the caller remote access to log in to the computer. In some cases, the consumer is then offered a preventative service for a fee. The scam: The caller does not work for Microsoft. Never give personal or financial information to an unsolicited caller. Don’t agree to purchase over the phone.

I’ve worked with a lot of out of area investors looking for multifamilyproperty in Huntsville. One most be extremely cautious. Most of theavailable properties are in undesirable areas where it is very difficult tofind stable tenants. There is a high turnover and make ready costs betweentenants can be a cash flow killer. It’s rare that well priced properties indecent areas are posted on MLS. Most sales of desirable properties are aresult of word of mouth.
The other issue is finding hands on, consistent property management. Thereare few local managers willing to handle multifamily. From our perspectivethey are a poor investment of resources. It takes at least twice as manyresources to manage a $400 – $500 rental as it does to manage a $2,000rental. Our income from cheaper properties is a fraction of what we earn onthe larger homes.
There are only a handful of local managers that are taking on multifamilyproperties. It’s hit and miss on weather their clients are happy with theirservice.

With market values going down in most markets, taxpayers would like to turn the sale of a personal residence loss (which is not deductible) into a capital loss (which is deductible) but it could potentially backfire if it is not handled correctly
Active participation standards are met if the taxpayer or the taxpayer’s spouse participates in management of the rental property in a significant and bona fide sense. For example, management decisions such as approving new tenants, deciding on rental terms, approving expenditures, and similar decisions meet active participation standards.
This said it is important that simply “saying” you perform these duties is not adequate. They must be documented in the form of signed leases, emails approving expense, rental and property management decisions, approve repairs and maintenance quotes, etc. Documentation is key to preventing the IRS from disallowing these deductions. Simply put the IRS cannot audit air, only what is documented.
This does not prevent homeowner’s from engaging in a property manager to assist them with operating the property but they must stay involved.
Lastly the $25,000 special loss allowance benefit begins to be reduced starting at a $100,000 of adjusted gross income for someone married filing joint and completely phases out at $150,000 Adjusted gross income. AGI.
There is a difference between a Huntsville homes for sale being treated as an investment/rental property and rent incidental to a sale. A six month lease would probably be considered as rent incidental to a sale. This expenses would just increase basis of the personal residence. Leases should be for at least a year.
Each situation has specific circumstances and this information should be reviewed with a qualified tax professional before relying on it’s accuracy and application This is general information about meeting the “active participation” standards which would allow a real property owned to deduct these losses.

The bottom line is the IRS will look at the facts and circumstances of a taxpayer’s position and if they deemed as tax avoidance they will disallow that position.

204 COVEVIEW ROAD is on Keel Mountain within a few miles of the Blowing Cave house.

I did talk to our home inspector about log homes out of concern for draftiness and settling. He indicated that with modern construction and chinking between the logs the draftiness has been eliminated and with aged, dried logs settling is minimal.
The house has been on the market since 08/03/11. The link below is to the listing where the current owner bought the house in 2005 for $175,000. There is limited information on the original listing but I cant see where there were substantial improvements to the property since 2005. 2005 was near the peak of our real estate market and the house was on the market 183 days before selling. Unless I am missing something the property seems to be priced above what the market will bear.

The house has been on market since 11/15/11.

While the sale of the house to the current owner is not recorded in MLS and the online probate records do not include the original purchase mortgage, the attached file ” Evers” is a mortgage assignment indicating that the original mortgage was dated 11/24/03.

The average sold price in the neighborhood in 2003 was $75 per square foot so we could expect that seller bought the house for something in the $120,000 range. Unless seller has refinanced or taken a second mortgage that are not showing in the probate records, they have room to negotiate.

At the current average sold price of $90 per square foot this 1,600 sf house would be $144,000. Note that prior listings of the home indicated 1,575 and 1,577 square feet.

I am a little concerned about all of the bedrooms being upstairs. It may not make the best retirement house, will make an eventual resale more difficult and will imit perspective tenants to some degree.

Received from a friend who is in the insurance property business. It is well worth reading.
The original message was written by a lady whose brother and wife learned a hard lesson this past week.
Their house burnt down… nothing left but ashes. They have good insurance so the house will be replaced and most of the contents. That is the good news.
However, they were sick when they found out the cause of the fire. The insurance investigator sifted through the ashes for several hours. He had the cause of the fire traced to the master bathroom. He asked her sister-in-law what she had plugged in the bathroom. She listed the normal things…curling iron, blow dryer. He kept saying to her, ‘No, this would be something that would disintegrate at high temperatures.’ Then her sister-in-law remembered she had a Glade Plug-In, in the bathroom.
The investigator had one of those ‘Aha’ moments. He said that was the cause of the fire. He said he has seen more house fires started with the plug-in type room fresheners than anything else. He said the plastic they are made from is THIN. He also said that in every case there was nothing left to prove that it even existed. When the investigator looked in the wall plug, the two prongs left from the plug-in were still in there. Huntsville Alabama Real Estate
Her sister-in-law had one of the plug-ins that had a small night light built in it. She said she had noticed that the light would dim and then finally go out. She would walk in to the bathroom a few hours later, and the light would be back on again. The investigator said that the unit was getting too hot, and would dim and go out rather than just blow the light bulb. Once it cooled down it would come back on. That is a warning sign.
The investigator said he personally wouldn’t have any type of plug in fragrance device anywhere in his house. He has seen too many places that have been burned down due to them.

You can see that the sold listing shows 7 acres while the current lisings shows 4.12 acres. This concurs with the information we have on the owner having sold land to the neighbor.

My my reckoning the tax plat below indicates the home has a little over the 4.12 acres stated on the listing.

As mentioned, it will be difficult to find comparable sales. Starting with the immediate neighborhood. The link below is to the home that I pointed out that sold in 2010. It was a much larger home and was on the river. It is however frame construction, is older and only has 2.8 acres. It sold in 104 days at $450,000 / $114 per square foot.

Many of the homes are much further from the city, have varying lot sizes and some are on hillsides with less useable land. While 4001 MAYSVILLE ROAD looks great in the photo, there is a warehouse / truck terminal just out of frame on the left.

My impression is that the list price the subject property would be a fair price. Since this is a short sale and we will be negotiating with the lender rather than the seller we need to view the transaction from the lender’s perspective.

I researched the Madison County probate records for mortgages on the property. The link below is to the original first mortgage for $244,000. Note that the loan is an adjustable rate mortgage. The original interest rate was 5.75%

While traffic will increase over time Powell Road ends about a mile and half to the west. There is a pond to the immediate west of the house.Just south of the pond there is a shed or barn with what looks like a stock handling yard. There is not any livestock in the image and there is grass growing in the pen. If the pen was seeing use there wouldn’t be grass.

Further to the west and closer to the road there is a shed that may have some vehicles or equipment composting. This is pretty common on farms and may not be a point of concern. Further west there is a house and then an old mobile home.

After the mobile home there is a small church.

There is an odd set of three buildings that sit off the road on a dirt drive. I can’t tell what this property is but it’s far enough from the subject home that a stable or farm operation wouldn’t have much impact.

With the exception of a TVA substation at the west end of Powell Road the other properties in the street are homes, small farms and a couple of mobile homes.

To the east to the property there is a house and then a new housing development GREENBRIER WOODS .

To the south there is housing and to the southwest there is more housing. While the property may not be landlocked future, close by development is doubtful.

You may experienced in purchasing short sales and foreclosure homes but if you aren’t I wanted to prepare you for some of the hurdles;

Short sales are especially difficult in that we may have to wait weeks if not months to hear back from the lender on offers. Because it takes so long for the lender to respond there may be multiple offers. Some lenders are fairly efficient but most aren’t.

On foreclosures we need to take a close look at the property condition and compare it’s price to that of recent Huntsville MLS comparable sales. Often foreclosures are not priced well and it takes the lender many months to over a year to lower the price to what the market will bear. Foreclosure properties are also more difficult to finance. In Alabama the borrower who lost the house or his assignee have the right to redeem the property for one year from the date of the sale. Properties are rarely redeemed but lenders require a redemption bond to protect their interests from the possibility of redemption. The last bond I was party to cost around $2,200.

The link below is to the Google image of the Berry Road house. It is a quiet street with little traffic. There are woods on both sides and at the back of the house. I did hear someone practicing drums for a little while. I think the sound was coming from the the house to the north. The one nearest the street. It didn’t last for long and it was in the late afternoon.

I had asked the listing agent of the 2737 County Road 8 to better map the property location in the Huntsville MLS so we could locate a satellite image. She blew me off saying she had mapped the house as close as possible to it’s actual location. I asked for landmarks to help locate the house on satellite but she didn’t respond.

After seeing the house in person I think the link below is to the actual location about a mile west of where she had placed it. The commercial building in front is Kennedy Used Cars. The front on Kennedys doesn’t look too bad but there are lots of semi trucks and junk cars parked on the right side and rear of the building. It looks like they are mining gravel or chert out of the hillside behind the building as well. There was a track hoe with a front end loader parked behind the building. You can see the commercial property and earthworks from the front porch of the house. The commercial operation is about 100 yards from the house.

The stove and water heater are propane but the tank has been removed.

When I walked up to the house I flushed an Armadillo and saw where he was digging tunnels in the yard.

The house itself is pretty nice but has some deferred maintenance. I did note lightning rods on the house. A good idea being located on the edge of mountain. The view is breathtaking but the surrounding property will make this house a tough one to sell.

If the listing agent had been forthcoming we may have saved the trip.

Location on this home is questionable. It’s pretty far out of the city. While schools are not important to you they will be on an eventual re-sale The primary school is considered good but the high school is not the greatest.

From selling at $192,000 to being listed at $150,000 for three monthswithout selling might be an indication the neighborhood is in decline.
I review available multifamily homes for investor clients and the only on onthe Huntsville MLS market I could really reccomend them reviewing is.

I think it’s priced a little high for the market but it is in a stable area.
My preference is single family property. Its more liquid, has betterappreciation and is much easier to manage. The cash flow is not as good asmulti-family but it’s a much safer investment.

Depending on how much work the current owner had to do to the building when he bough it, his break even point on a sale will be in the $140,000 range.

The rents that are stated on teh listing look to be in line with what I would expect.

We went to xxx yesterday to consider managing it as a rental. It may not be the best candidate for you. The house and land itself are attractive and pleasant I was however surprised at the amount of traffic, the speed and the noise of the traffic. The house is close to the road and while it’s quiet inside, outside is anything but peaceful.

While schools aren’t an issue for you personally, at an eventual resale they will be an issue. The high school has average rankings and the elementary school is quite good.

The house went on the market 10/23/10 for $259,900. On 07/10/11 the price dropped to the current $249,900.

Assuming normal seller transaction costs and contributions the seller’s breakeven point on a sale is in the $249,000 range. (The current list price.) It looks like the seller and listing agent did the same calculations as I did.

The owner approached me about leasing it for him as it hasn’t sold since being on market since 10/23/10. The owner said there were two wet weather creeks that ran most of the year. He said that the house sites close to the road which turned off some prospective buyers.

While the house is very attractive, it may not meet your needs. There is not a garage or a lot of storage.

The house is built on the uphill corner of the lot close to the road. Except for the far side of the house from the street or downhill from the house, there is not room for an addition or garage. I researched the surrounding lots ownership. They are owned by a development company.



























I may be wrong but the unpaved road above the house may be acess to undeveloped lots.

Since the house is in Limestone County ( but in the Madison City limits.) I had to go to the Limestone County tax records. There is not a map search feature to find ownership of a given plot but the map below shows one section of land adjacent to County Line Road.

My concern is that this land will eventually be developed for commercial use and you might loose the privacy.

It was listed for a short time in 2010 at $74,000 without selling. It has been listed this year since 06/29/11.

144 CASTLE RIDGE DRIVE is a house in New Market. I know you prefer a condo but single family homes are a lot easier to sell. Also it will be safer. While Willow point and Old Monrovia Road are not crime ridden. They are in the news on occasion for both property and violent crimes. The schools that serve the condos are not very good either, hurting the ability to eventually re-sell.

The seller painted in some pretty bold colors that will make the house harder to sell but for a few hundred dollars we can repaint.
