Housekeeping Issues and Fair Housing The Alabama Landlord-Tenant Act specifically requires that a tenant 'dispose of garbage, rubbish, and waste in a clean and safe manner' and to keep the unit 'clean and safe'. Ala. Code 35-9A-301. On occasion, however, you will have a tenant who is unable to clean a home because of a physical or mental disability. For example, an individual in a wheelchair, or with limited mobility, may not be able to take their garbage to the dumpster. Mental illnesses can also interfere with keeping a unit clean (the 'hoarder' as pictured left). When the tenant's inability to maintain the rental premises is caused, in whole or in part, by a handicap you have an intersection with Fair Housing laws. Fair Housing mandates that a tenant cannot be evicted for conduct that is a result of their disability. For example, a landlord cannot evict a mentally ill tenant because a disturbance was caused when emergency workers responded to his suicide attempt. In the same vein, poor housekeeping alone cannot sustain an eviction if the tenant cannot clean the unit due to disability. This does not give disabled tenants a license to litter. Fair Housing will not protect a tenant whose conduct is a "direct threat" to the health or safety of other tenants. It also does not protect a tenant who causes substantial physical damage to property UNLESS a reasonable accommodation can alleviate the situation. Sample reasonable accommodations may be arranging for a local service organization to provide housekeeping for the tenant or providing trash pickup service for tenants with limited mobility. As always, when dealing with an issue that implicates Fair Housing, it is best to discuss your proposed conduct with a lawyer versed in the law.
